Privacy Policy

Last Updated: September 17, 2025

Frameshift AI Labs, LLC ("PopFrame," "we," "us," or "our"), which owns and operates the popframe.ai and popframe.art websites, is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and safeguard your personal information when you use our website, applications, and Services, or otherwise interact with us. It also describes your rights and choices regarding your personal information. This Privacy Policy is incorporated into our Terms of Service. If there is any conflict between this Policy and the Terms of Service with respect to privacy matters, this Privacy Policy will control.

Please read this Privacy Policy carefully. By using PopFrame's Services, you acknowledge that you have read and understood this Policy and agree to the collection, use, and disclosure of your information as described herein. If you do not agree, please discontinue use of our Services.

1. Personal Information We Collect

We collect various types of personal information from and about users of our Services. This may include:

  • Contact Information: such as your name, email address, telephone number, billing and shipping address, and other contact details. We collect this information when you register an account, make a purchase, or contact us for support.
  • Account Credentials and Profile Details: when you create an account on PopFrame, we collect a username, password, and any profile information you choose to provide (for example, a display name, biography, profile picture, or social media links).
  • User Content and Art Information: any images, photographs, art descriptions, text prompts, or other content you upload, generate, or submit to the Services. This can include the digital artwork you create using our AI tools, the metadata about your creations (like titles or tags), and any comments or feedback you provide. (Note: User Content may be subject to additional terms in our Terms of Service, but to the extent it is linked to you or could identify you, we treat it as personal data under this Policy.)
  • Transaction and Payment Information: if you purchase products (like prints or frames) or services (such as subscription credits) from PopFrame, or if you sell artwork through our marketplace, we (or our third-party payment processor) collect information related to the transaction. This may include your payment card details or PayPal information, billing address, the items purchased, order date and time, and transaction amount. Financial information (like credit card numbers) that you provide for purchases is generally collected directly by our payment processors and not stored in full on our systems (though we may retain non-sensitive details like the last four digits of your card, expiration date, and billing address for record-keeping).
  • Communications: any information you provide when you contact us or respond to our communications. For example, if you send us an email with a question, we will collect your email address and the content of your message. If you participate in surveys, contests, or promotions we offer, we will collect the information you submit in those contexts. We may also collect information you share when you post reviews, testimonials, or feedback on our Services.
  • Device and Usage Information: details about how you access and use our Services. This includes:
    • Device data: Information about the device and browser you use, such as your device type (e.g., phone, tablet, desktop), operating system and version, browser type and version, screen resolution, and device identifiers or advertising IDs.
    • Log data: Our servers automatically record certain information when you visit or use our website/app. This can include your Internet Protocol (IP) address, unique device identifiers, pages viewed, date and time of access, referring URL (the page you came from), and your interaction with links or features of the Services.
    • Cookies and similar technologies: We (and authorized third parties) use cookies, web beacons, and other tracking technologies to collect information about your interactions with the Services. This can include your preferences, clicks, and other actions on our site. (See Section 4 on Cookies & Advertising for more details.)
  • Location Information: We may infer your approximate location from your IP address or shipping address (for example, determining your city or country). We do not collect precise GPS location from your device, but IP-based location helps us customize the Services (such as displaying content in your language or currency) and comply with regional requirements (like tax calculation or legal rights).

2. How We Collect Personal Information

We collect personal information from and about you in a variety of ways:

  • Directly from you: We collect information that you provide to us directly. For example, you give us personal information when you register an account, fill out forms on our site, make a purchase, upload content, or communicate with us.
  • Through automated technologies: As you use our Services, we (and our service providers) may automatically collect certain technical data and usage information as described in Section 1 (Device and Usage Information), using tools like cookies, log files, and analytics scripts.
  • From third parties: We may receive information about you from third parties. For example, if you register or log in via a social media or third-party account (such as Facebook or Google), that platform may share certain information with us (subject to your settings and their privacy policies). We may also receive information from payment processors (e.g., confirmation of payment) or advertising partners. We treat any information obtained from third parties according to this Privacy Policy, plus any additional restrictions imposed by the source of the data.

3. How We Use Personal Information

We use the personal information we collect for a variety of purposes to operate our business, provide our Services to you, and improve your experience. These purposes include:

  • Providing and Improving Services: We use information to operate the Services and provide features to you. This includes processing your orders and transactions (using contact and payment info to fulfill purchases and deliver physical products), displaying your artwork and gallery, personalizing your experience, and developing new features or services. We may also use information to troubleshoot issues, conduct data analysis, and generally improve the functionality and quality of our Services.
  • Communicating with You: We use your information to provide customer support, respond to your inquiries, and send you administrative or account-related messages (such as order confirmations, password resets, or updates to our terms and policies). These communications are necessary for us to provide the Services and manage our relationship with you.
  • Marketing and Promotional Communications: We may use your contact information (like your email) to send you updates, newsletters, marketing communications or promotional offers. For instance, we might email you about new features, art contests, or products that relate to those you've shown interest in. You can opt out of marketing emails as described below in Section 7 (Your Rights and Choices).
  • Advertising and Retargeting: We use cookies and third-party advertising tools to show you personalized ads related to PopFrame on our site and on other platforms. The information collected (such as your interactions on our site or an advertising identifier from your device) is used to serve ads more relevant to your interests. (See Section 4 on Cookies & Advertising for more details on your advertising choices.)
  • Analytics and Service Improvement: We use analytics services (like Google Analytics or similar tools) to understand how users find and use our Services, and to identify areas for improvement. These tools may collect information such as which pages you visit, how long you stay, and what actions you take, which helps us make informed decisions about enhancements and optimizations.
  • Security and Fraud Prevention: We may use your information to maintain the security of our Services, including to monitor for fraudulent, suspicious, or illegal activity. For example, we might use data to verify accounts, detect malicious behavior (like bot use or spam), and to enforce our Terms of Service.

4. Cookies & Advertising

We and our partners use cookies, pixels, and similar tracking technologies to operate and analyze our Services and to deliver personalized advertising. Cookies are small data files stored on your device that help websites remember information about you. We use cookies to enable site functionality (such as keeping you logged in or remembering your preferences), to understand usage and improve performance, and to personalize content and ads.

For example, we may partner with advertising networks that use cookies and ad identifiers to collect information about your browsing activities on PopFrame and other sites, in order to show you relevant ads on other websites (sometimes called "retargeting"). These practices might be considered a "sale" or "sharing" of data under certain privacy laws, because they involve sharing cookie or device identifiers with third-party advertisers. You can opt out of certain cookie-based tracking as described in Section 7 (Your Rights and Choices) below.

Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies or alert you when cookies are being sent. Please note that if you disable cookies, some features of our Services may not function properly. If you enable the Global Privacy Control (GPC) in your browser (and you are in a location where GPC is recognized as a valid opt-out signal, such as California), we will treat that as a request to opt out of cookie-based data sharing for targeted advertising on our site.

5. How We Share Your Personal Information

We do not sell your personal information for money, but we do share certain information for business purposes or as otherwise described here. We may share your personal information in the following circumstances:

  • Service Providers: We share personal information with third-party service providers that help us operate our business and provide the Services (for example, payment processors, shipping partners, cloud hosting providers, or email service providers). These companies are authorized to use your personal information only as necessary to provide services to us.
  • Advertising Partners: As described in Section 4, we may allow third-party advertising partners to set technologies (like cookies or pixels) on our site that collect information about your use of the Services over time and across different sites. These partners may use this information to display targeted ads for PopFrame on other websites. Under some state laws, such sharing for online advertising could be considered a "sale" or "sharing" of personal data. You can opt out as explained in Section 7.
  • Social Media and Integrations: If you choose to use features on our Services that connect to third-party social networks or other platforms (for example, using a "Share" button or logging in through another platform), any information you provide or that is collected by those third parties is governed by their privacy policies. For example, if you use a Facebook "Like" button on our site or choose to log in via Facebook, Facebook's own privacy policy will apply to the data transmitted to and from that feature.
  • Business Transfers: If PopFrame is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or other business transaction, your information may be transferred to a successor or affiliate as part of that transaction. In such cases, your personal information will remain subject to the protections of this Privacy Policy (unless you are notified otherwise and, if required by law, consent to any new uses or disclosures).
  • Legal and Safety Disclosures: We may disclose personal information when we believe in good faith that such disclosure is necessary to comply with a legal obligation (for example, in response to valid subpoenas, court orders, or government requests); to protect and defend our rights or property, or the rights or property of others; to prevent or investigate possible wrongdoing in connection with the Services; or to protect the personal safety of our users or the public.
  • With Your Consent: We may share your personal information for other purposes pursuant to your direction or with your explicit consent. For instance, if you instruct us to share data with a third-party service, or you post content in a public area of our platform (which by nature will be accessible to others), we will share it as you have directed or consented.

6. Data Security and Retention

We take reasonable measures designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. This includes implementing technical and organizational security measures appropriate to the sensitivity of the data. However, no security measure or method of transmission over the Internet is 100% secure, so we cannot guarantee absolute security of your information. You should also take care with how you handle and disclose your personal information and credentials, and notify us immediately if you believe your account or personal information has been compromised.

We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. For example, we keep your account information while your account is active and for a reasonable period thereafter in case you decide to re-activate or as needed for legal purposes. We may also retain certain data after you close your account or request deletion, if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud or abuse, or enforce this Privacy Policy and our Terms of Service. When we no longer have a legitimate need to keep your personal information, we will delete or anonymize it.

7. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights regarding your personal information. These rights may include:

  • Right to Access: You have the right to request that we confirm whether we are processing your personal information and to request access to the personal information we hold about you. Where required by law, we will provide you with a copy of your personal data in a portable format.
  • Right to Correction: You have the right to request that we correct or update any inaccurate or incomplete personal information we hold about you.
  • Right to Deletion: You have the right to request deletion of your personal information, subject to certain exceptions (for example, we may retain information as required by law or for legitimate business purposes). When you request deletion, we will remove or anonymize your personal information in accordance with applicable laws.
  • Right of Portability: In some cases, you have the right to obtain a copy of personal information you provided to us in a structured, commonly used, and machine-readable format, and to request that we transmit it to another organization where technically feasible.
  • Right to Opt Out of "Sale" or "Sharing" / Targeted Advertising: If you are in a jurisdiction that defines certain data disclosures as a "sale" or "sharing" for targeted advertising purposes, you have the right to opt out of such practices. As described earlier, we do not sell personal information for monetary compensation. However, we do share data with third-party advertising partners to help deliver personalized ads, which might be considered a "sale" or "sharing" under some laws. You can opt out of this kind of data use by adjusting your cookie settings or using industry opt-out tools for advertising cookies. Additionally, if you enable the Global Privacy Control (GPC) in your browser and we recognize it as a valid opt-out signal in your jurisdiction (e.g., for California residents), we will treat that as a request to opt out of cookie-based targeted advertising on our site.
  • Right to Opt Out of Profiling: If we engage in automated decision-making that produces legal or similarly significant effects concerning you (for example, purely algorithmic decisions about eligibility for services or offers without human review), you may have the right to opt out of such profiling or to request human review of those decisions. (At this time, PopFrame does not make any significant decisions about individuals using solely automated decision-making without any human involvement.)
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. This means we will not deny you Services, charge you a different price, or provide a lesser quality of services just because you exercised your rights. However, note that if you ask us to delete your data or opt out of certain processing, it may affect your experience with the Services (for example, we cannot provide personalized recommendations if we cannot use your data, and deleting your account data will remove access to account-specific features).

To exercise the rights applicable to you, you may contact us using the information provided in the Contact Us section below. Please clearly describe your request โ€“ for example, "I am requesting a copy of my personal data" or "Please delete my account and personal information." We will need to verify your identity before fulfilling certain requests, to ensure that we do not disclose or remove information to the wrong person. Verification may involve confirming that the request comes from the email address associated with your account, or asking for additional information if needed. In some cases, we may refuse or limit a request if we have a lawful basis to do so (for instance, if you request deletion but we are required to keep certain data by law, we will explain that to you in our response).

If you would like to designate an authorized agent (such as an attorney or someone acting on your behalf) to make a request for you, we will take steps to verify the agent's authority and may still ask you or the agent to confirm your identity directly. We aim to respond to privacy requests within the timeframe required by applicable law. For example, in some jurisdictions we have up to 30โ€“45 days to respond. If we need more time, we will let you know and explain the reason.

If you have subscribed to our marketing emails or newsletters, you can opt out at any time by clicking the "unsubscribe" link in those emails or by adjusting your account settings (if available). Even after you opt out of marketing, you may still receive transactional or service-related messages from us (such as order confirmations or critical account notices) as those are necessary for providing our Services.

8. Children's Privacy

As noted in our Terms of Service and eligibility requirements, PopFrame's Services are not intended for use by children under the age of 13 (or under the age of digital consent in your jurisdiction, if higher). We do not knowingly collect personal information from children under 13. If you are under 13, please do not attempt to register for an account or send any personal information about yourself to us.

If we learn that we have inadvertently collected personal information from a child under 13, we will take steps to delete that information as soon as possible. If you are a parent or guardian and you discover that your child under 13 has provided personal information to PopFrame, please contact us and request deletion of the child's information. We will ask for proof of guardianship and then work with you to remove the data and (if applicable) terminate the child's account.

For minors above the age of 13 but below 18, we require that they use the Service only with the involvement of a parent or guardian, and that any personal information provided to us is with appropriate consent. Parents should talk with their teens about online privacy and monitor their internet usage.

9. International Data Transfers

PopFrame is based in the United States, and our Services are primarily directed to users in the U.S. However, we may have users or operations in other countries. If you are accessing our Services from outside the United States, please be aware that your personal information may be transferred to, stored, and processed in the United States or other jurisdictions where our servers or our third-party service providers are located. Data protection laws in those countries may be different from, and possibly not as protective as, the laws of your country of residence.

When we transfer personal information from the European Economic Area (EEA), United Kingdom, or other regions with data transfer restrictions, we will take steps to ensure that appropriate safeguards are in place. This may include using Standard Contractual Clauses or other lawful mechanisms to protect your personal data. You can contact us (using the information below) for more information about any data transfer safeguards we have in place.

By using our Services or providing us with your information, you understand that your data may be transferred to and processed in countries outside your country of residence. We will take measures to ensure that your data is subject to an adequate level of protection in the jurisdictions where it is processed.

10. Data Deletion Requests

You have the right to request the deletion of your personal data from our systems. If you would like to delete your account or personal information, please contact us by email at team@frameshiftlabs.ai with the subject line "Data Deletion Request." In the body of your email, please include your name and the email address associated with your PopFrame account, and clearly state that you are requesting deletion of your data.

If you registered for PopFrame via a third-party account (such as Facebook or Google), you may also need to request deletion of data through those third-party platforms, in accordance with their procedures. For example, if you signed up for PopFrame using Facebook Login, you should revoke PopFrame's access and request deletion via your Facebook account settings as well.

For your security and privacy, we will require verification of your identity before processing a data deletion request. This verification may involve confirming your request via the email associated with your account or asking for additional information. Once verified, we will delete your personal data and/or account information from our active databases. However, please note that we may retain certain information as required for legal compliance or legitimate business purposes โ€“ for example, records of transactions you made, or data stored in backup archives that will be deleted according to our retention schedule. We will inform you if we are unable to delete certain data due to legal obligations or other exceptions.

After we process your deletion request, your account will be closed (if applicable) and your personal data will be removed from our active systems in accordance with our policies. Some residual data may remain in encrypted backups or logs for a period of time, but it will be deleted in the normal course of business. If you had used a third-party platform to log in to PopFrame, we also recommend deleting or revoking PopFrame's access in that platform as an extra measure.

11. Updates to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will update the "Last Updated" date at the top of this Policy. If the changes are significant, we will provide a more prominent notice (such as by posting a notice on our website's homepage or by emailing you, if appropriate).

Please review this Privacy Policy periodically to stay informed about how we are protecting your information. Continued use of our Services after any update to this Policy constitutes your acceptance of the changes, to the extent permitted by law. If you do not agree to a new Privacy Policy, you should stop using the Services and can request that we delete your personal information as described in Section 10 above.
